How permanent are the marks made by these pencils? Do they smear and smudge ?

Two part answer. First, yes they are permanent. And yes they will smear and they will smudge and they will ruin any clothing that has the bad fortune to rub up against either the charcoal pencil or the drawing that you created while using them. That smudging and smearing is the beauty of charcoal. Until you spray the drawing you have created with a fixative, or a conservation varnish, you'll run the risk of everything in your question-happening.
