It shouldn't be. If you get it through Amazon recommend seller it's usually legit. If you recieve it and it's not, return it and get that refund. I've found that the longer you wait to buy these the more likely they will be off brand fakes... though some fakes aren't terrible.

The stand for the figure seems to help with the figure but is really wobbly and when I adjust it it falls over is there a way to fix that?

Just make sure its fully snapped into the foot. Mine didnt even really need the stand.
