My son is small for a 12 year old and wears size 10 pants. He is very thin. Would it be better for me to get him the size 8 so they are not loose?

I honestly wouldn't recommend them at all. My 10.5 year old got holes in all three within a few months (and not from crawling on the ground). BUT if you want to try them, my son still fits in 8/10 and I got him medium. I don't think they were very baggy.

Can I have my toes out when he wears this and can they be super tight?

Toes are out and depending on size, they are tight. Not overly tight, just a nice fit.
