I got mine up to 53, so yes, it does exceed 40

They never shipped it to me. Place is a fraud

Do not know about the cold but i have rode mine i the hest in Florida in the 90s no problem it does run in the rain but i would not do it if i could avoid it but i have rode mine in the rain no problem

Yes, any USA imported Electric bike, Which this is, is by default restricted to 28mph. No reg needed. Otherwise you need to register it over this speed, doing of 40+mph. But many don't bother and get a way with it theses days. Your call. Research this before you buy it. Seems overpriced for what it is. QC wise.
